Rental Contract

This Rental Agreement with ("Backyard party rentals Idaho") is made and entered into on the dates you have selected in your reservation. This is to be the "Effective Dates by and between [Backyard party rentals Idaho], hereinafter referred to as the "Company", and the individual or entity making an online reservation, hereinafter referred to as the "Customer".

1. Rental Items: The Company agrees to rent the items listed on its online reservation platform to the Customer for the specified event. The Customer acknowledges that the list of available items may vary and is subject to availability. Not all items are always available.  We reserve the right to refuse reservations for any reason.

2. Rental Period: The rental period shall commence on the date and time specified in the online reservation and shall terminate on the date and time specified in the reservation. Any extension of the rental period must be made through the online reservation platform and is subject to availability. Please call, text or email us as soon as possible if there are any further needs.

3. Delivery and Pickup: The Company shall deliver the rented items to the event location on the specified date and time selected by the Customer during the online reservation process. The Customer agrees to provide clear access to the delivery location and to be present for the delivery and pickup. Any additional delivery or pickup services shall be subject to additional fees.

**Free delivery is only available within a 12 mile radius of our location and a $100 reservation. 

** Deliveries beyond the 12 miles are subject to a delivery fee, $30 is the minimum charge additional fee could be applicable based on mileage. Customers are always welcome to pick-up and return their rentals as an option. 

** No credit will be given for unused items once delivered.

4. Normal Usage and Cleaning: The Customer agrees to use the rented items in a careful and proper manner by them and their guests and to follow any instructions provided by the Company. Normal wear and tear are expected and are included in the rental fee. If you are travelling to another location with any product, you must use the moving blanket provided by us.  Please be sure to protect all items and ensure secure transportation of all rented items. All items that are damaged during your transport are subject to damage fees.  This includes excessive scraping to any item. It is your responsibility to secure the load when pick up and returning all rental items. Items that are stacked on carts incorrectly and are damaged are included. Please be sure to stack carts properly. 

** All Items need to be returned CLEAN!  Items that are soiled with food or anything else will result in a cleaning fee of $5 per item.  Please be sure to wipe down and clean items before stacking.

    Usage regarding propane: Depending on your planned usage, you may want to have your own back up propane tank.

You may not exchange our tanks at a store or trade it with one of yours. The tank we drop off is the tank that needs to be returned. You may refill our tank at an authorized fill station only.  Any unused propane after a station refill made by you, becomes property of Backyard Party Rentals llc Idaho.

Any tank the belongs to "Backyard Party Rentals llc Idaho " that is exchanged at an exchange facility or traded, regardless of what is returned to us is subject to a $75 fee. No exceptions.

5. All subrentals require a nonrefundable deposit.

6. Damage and Loss: The Customer shall be responsible for any damage to or loss of the rented items during the rental period, regardless of if it is the renter's fault or renters' guest fault. The Customer agrees to pay the Company the full replacement cost for any damaged or lost items. This may exceed your deposit amount. If you paid a deposit and have to replace an item your deposit will count toward the replacement of the item (s) and you will still be required to pay the difference.  In this agreement you authorize us the "Company" to charge your card on file for these additional charges.

7. Deposit: A deposit of 30% of rental reservation is required at the time of online reservation. Deposits must be made with in 24 hours of making the reservation.  Any deposit not paid within this time will result in a cancelled reservation. The deposit amount and terms for refund or forfeiture shall be specified on the online reservation platform. Deposits are fully refundable when all items are returned on time in satisfactory condition. Late returns are subject to a late fee which is 50% of your reservation order.  Late fees will be charged when no communication has been made about the return and when the return is excessively late without any arrangements or communication with us prior. Time may be extended if needed for a fee if items are available.

8. Payment: The total rental fee, including any additional charges for delivery, pickup, or damages, shall be paid by the Customer in accordance with the payment terms specified on the online reservation platform. All rental balances must be paid at the time of pick up or delivery.  Any reservation that has an unpaid balance at the time of delivery, agrees to authorize payment for the remaining balance with the card on file at the time of drop off. If a cash payment arrangement has previously made that will stand in place.  All Cash payments must be noted in the reservation notes previously AND agreed to by us Backyard party rentals. Deposits must still be made with a card.

9. Cancellation: The Customer may cancel the reservation through the online reservation platform. Cancellation terms and any applicable fees shall be specified on the platform. Free cancellations are accepted up to 48 hours prior to rental period. (ex:  your rental period starts at 9am on Saturday, you must cancel by 9am on Thursday) If a cancellation needs to be made after the 48-hour window has closed, the cancellation fee is 30% of your entire booking reservation.  This will be charged to your card on file upon cancellation.

10. Indemnification: The Customer agrees to indemnify and hold harmless the Company from any claims, damages, or liabilities arising out of or related to the customer's use or the customer's guest use of the rented items.

11. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of State of Idaho.

By making an online reservation, the Customer acknowledges that they have read, understood, and agreed to the terms and conditions of this Agreement.

IN WITNESS WHEREOF, the parties hereto have executed this Agreement as of the Effective Date.
